BINDING INTERNATIONAL INSTRUMENTS

Decision 391 of the Andean Community of Nations (CAN) on access to and benefit-sharing of genetic resources: a regional instrument that regulates access to genetic resources in CAN member countries.

Convention on Biological Diversity: an intergovernmental agreement that establishes the principles governing the conservation, sustainable use, and fair and equitable sharing of benefits arising from biological diversity.

International Treaty on Plant Genetic Resources for Food and Agriculture: an intergovernmental treaty focused on the conservation, sustainable use, and benefit-sharing of plant genetic resources.

Nagoya Protocol on access to genetic resources and the fair and equitable sharing of benefits arising from their utilization.

NATIONAL INSTRUMENTS

Constitution of the Republic of Ecuador, Official Registry (R.O.) No. 449, October 20, 2008. Article 281 states:
“Food sovereignty is a strategic objective and an obligation of the State to ensure that individuals, peoples, and nationalities achieve permanent self-sufficiency in healthy and culturally appropriate food.” (Constituent Assembly, 2008)

According to the Organic Code of the Social Economy of Knowledge, Creativity, and Innovation, the competent authority for granting access contracts for commercial purposes is INABIO, and for research framework agreements, it is SENESCYT. (National Assembly, 2016)

A key legal instrument for the sustainability of the gene bank is the Law on Agrobiodiversity, Seeds, and the Promotion of Sustainable Agriculture, enacted on June 8, 2017, Official Registry No. 10. (National Assembly, 2017)
